When officers arrived they spoke with two occupants from a car that was hit after police say Bendel failed to yield. One occupant suffered bruising, scratches and a cut on her knee and the other occupant hit his head on the windshield. They both told police Lambo had trouble walking and slurred his speech when they spoke with him following the accident.

Lambo told police he had two or three vodka drinks earlier that day and he was on Oxycodone. Police say he appeared intoxicated, and later failed field sobriety tests. He registered a 0.15 blood alcohol content during a Breathalyzer, nearly twice the legal limit.
