On April 12, Tomic stopped for a westbound red light at the intersection of West Layton Avenue and West Loomis Road, then decided to drive again while the light was still red. His van was hit by another car and Tomic was ejected from the van in the accident.

Tomic was found by police laying in the middle of the intersection and an eye test showed he may have been under the influence and he smelled of alcohol. Officers were unable to perform other field sobriety tests due to injuries Tomic sustained in the crash, but a blood sample was taken after he was transported to the hospital.

He was previously convicted of OWI in 2007. He will make his initial appearance in court Thursday.
